1. Introduction

Agassi Sports Entertainment Corp. (“we,” “us,” or “our”) operates the Agassi Coaching App (“Service”). This Privacy Policy (this “Policy”) explains how we collect, use, disclose, and protect your personal information when you use our Service.

We are committed to compliance with applicable privacy laws including the California Consumer Privacy Act (CCPA/CPRA), Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), Quebec’s Act Respecting the Protection of Personal Information in the Private Sector (Law 25), and other applicable legislation.

By enabling features involving mood tracking, emotional check-ins, health and fitness inputs, swing video analysis, or sensor-based movement analysis, you expressly consent to our collection, use, and processing of this sensitive information for the specific purposes described in this Policy.

 
2. Information We Collect

2.1 Information You Provide Directly

  • Account information: username, email address
  • Profile information: skill level, frequency of play, goals
  • Mood and emotional state inputs provided during coaching sessions
  • Communications with human coaches through the platform
  • Feedback and survey responses

 

2.2 Information Collected Automatically

  • Device and usage data: device type, operating system, app version
  • Session data: features used, session duration, interaction patterns
  • Log data: IP address, access times, error reports
  • Performance data from tennis swing analysis (video or sensor data where applicable)

 

2.3 Sensitive Personal Information

The following categories of information are classified as sensitive and are subject to heightened protection:

  • Mood and mental/emotional state data
  • Health and fitness related information
  • Biometric or movement data derived from swing analysis
 
3. How We Use Your Information

3.1 Service Delivery

  • Providing personalized coaching recommendations and swing analysis
  • Enabling communication between you and human coaches
  • Tracking your progress and adapting training programs
  • Sending service related notifications

 

3.2 AI Model Processing

Your data including profile information, mood inputs, swing data, and interaction history is processed by our AI systems and trusted AI service providers to generate personalized recommendations, session adjustments, and performance insights.

We do not use your personal data to train or improve our underlying AI models without your explicit consent, except as discussed in “3.4 Product Improvement (Beta)” below.

 

3.3 Automated Decision Support

Some recommendations, skill assessments, training adjustments, readiness scores, and progress insights may be generated automatically using AI models based on your profile, swing data, session history, and coaching interactions.

Where required by applicable law, you may request information regarding the categories of personal information used, the principal factors influencing the recommendation, and request review by a qualified human coach.

 

3.4 Product Improvement (Beta)

During the beta period, we may use de-identified, aggregated, and statistical data to improve the Service.

We will not use personally identifiable information for this purpose without your consent.

 

3.5 Legal Compliance

We may use and disclose your information as required to comply with applicable laws, regulations, legal processes, or governmental requests.

 
4. Data Sharing and Disclosure

4.1 Third Party Service Providers

We share data with trusted third party providers who assist in operating the Service, including:

  • Cloud infrastructure providers (data storage and processing)
  • AI model providers (for generating coaching recommendations)
  • Analytics providers (for service improvement using aggregated data only)
  • Communication tools (email, in app messaging)

 

Certain data inputs used for AI generated coaching recommendations may be processed by service providers located in the United States, Canada, or other jurisdictions where our providers operate.

All third party providers are contractually bound to process your data only as directed by us and to maintain appropriate security standards.

 

4.2 Human Coaches

Human coaches on the platform will have access only to the information reasonably necessary to provide coaching services, including your profile, relevant training data, mood inputs related to coaching sessions, and communication history within the platform.

Coaches are bound by confidentiality obligations and subject to role based access controls and audit logging.

 

4.3 We Do Not Sell Your Data

We do not sell personal information in exchange for monetary compensation.

However, certain disclosures for targeted advertising or analytics may be considered “sharing” under CCPA/CPRA or other state privacy laws, for which you have the right to opt out where applicable.

 

4.4 Business Transfers

We may disclose personal information in connection with a merger, financing, acquisition, reorganization, partnership, dissolution, or sale of all or a portion of our business or assets, subject to customary confidentiality protections and applicable legal requirements.

5.1 All Users

Depending on your location and applicable law, you may have the following rights:

  • Right to access: request a copy of the personal information we hold about you
  • Right to correction: request correction of inaccurate information
  • Right to deletion: request deletion of your personal information, subject to legal exceptions and applicable law

We implement industry standard technical and organizational measures to protect your personal information, including encryption in transit and at rest, access controls, audit logging, vendor diligence, and regular security assessments.

However, no system is completely secure.

 
7. Data Retention

We retain your personal information for as long as necessary to provide the Service and comply with legal obligations.

  • Mood and emotional state data is retained for no longer than 90 days unless you elect to preserve longer term performance history and wellness trend insights.
  • Swing videos, sensor data, and movement analytics are retained only as reasonably necessary.
  • You may request deletion of your data at any time.
 
8. International Data Transfers

Your data may be processed and stored in servers located outside your country of residence, including in the United States and Canada.

Where data is transferred across borders, we ensure appropriate safeguards are in place consistent with applicable law.

 
9. Children’s Privacy

The Service may be used by individuals under the age of 18 only with verifiable parental or legal guardian consent where required by law.

We do not knowingly collect personal information from minors without such consent.

 
10. Changes to This Policy

We may update this Privacy Policy from time to time.

Continued use of the Service after notification constitutes acceptance of the updated policy to the extent permitted by law.
